mily & friends, decisions are not easy. Our aim is to offer you assistance every step of the way, with a wide variety of experiences to suit any occasion and most budgets. So whether you want an introductory experience to wet your appetite, or a full blown experience event we can help. We are very keen to build our business on the back of happy customers who by recommending us to others help us to offer such great experiences at such unbelievable value for money. By dealing direct with a supplier you are saving any potential high mark-ups. Our Commitment to you: 6th Gear Experience Ltd is committed to ensuring that all its customers enjoy driving experiences of the highest quality, which are safe, exciting and value for money. Whether, a novice driver or experienced professional we want you to feel welcome and enjoy expert tuition from our instructors in the best vehicles and pleasant surroundings. We know how much our customers enjoy their driving experiences so our terms and conditions have been carefully written to ensure that there are no misunderstandings, which could detract from your enjoyment. We recommend that anyone purchasing or booking their experience takes time to read the terms and conditions in full.
Your commitment to us: You will need to be sure to give yourself plenty of lead time for your booking, which can be as much as 8 - 12 weeks prior to the date of your event, as it is critical that your voucher validity date has not expired when you attend, as you will not be allowed to take part in your experience. Once you have booked your date, we reserve your car, instructor and circuit time. If you then choose to cancel, you will be in breach of contract and we reserve the right to retain all monies paid. Please speak to our customer care team on 01675 470425 or 05603 114969 to arrange Cancellation Indemnity and/or Waiver Indemnity cover. All customers must allow plenty of time for their journey, if they are late (arriving after their agreed arrival time stated on their letter) they will not be able to take part in their experience. The participating driver on the day must bring their driving license, gift voucher and their confirmation letter, without these you will not be able to take part. If you have lost your voucher we can replace it on request for a charge of £25; If you are a customer who has returned their voucher to us then you will need to produce your driving license and your confirmation letter to take part in your event. Directions to the venue are sent out as assistance only and customers are asked to plan their journeys carefully, 6th Gear Experience Ltd is not responsible for customers getting to the venue. All 'Buy a Gift' customers must bring their Driving License and Voucher, without these you will not be able to take part.
FURTHER INFORMATION (PLEASE READ CAREFULLY): We want you to enjoy your day so please ensure that you thoroughly read the following information. NOTE: Please arrive in good time for registration. We ask that you arrive at least 45 minutes before your scheduled start time so that you can receive relevant information before taking part in your event. We cannot permit anyone to participate in an experience without attending/receiving a drivers briefing. This can be as a group or with your instructor behind the wheel, this will vary depending upon which event you are doing.
All vouchers are normally posted out by first class mail, or if ordered before 3pm you can choose & pay for special next day delivery, we will send your vouchers out this way. This is not an option on Fridays as next day delivery cannot be guaranteed on a Saturday. In all delivery cases 6th Gear Experience Ltd cannot be held responsible for failure of delivery as we use the Royal Mail postal service and can only assume that they will fulfill their agreement as stated in their documentation.
- Complaints: - If you have a problem or complaint on the day, please bring it to the attention of the host or event manager/organiser at the venue as soon as possible so they have a chance to put matters right. In general, we consider it unreasonable if you take no action during an event, but then write a letter of complaint at a later date. It is difficult to put your issue right if you have already left the venue. Our corporate policy is to ensure all staff of 6th Gear Experience Ltd ensure that we have happy customers. Refunds cannot be issued after your event. If you have a situation with regards to any other matters, you can send a letter to our customer services department at the address below; our policy is to reply within 30 days.
- Gift Vouchers: - Gift Vouchers are issued either for a specific experience or a monetary value. Open Gift Vouchers are available from a minimum of £50. All gift vouchers are valid for ten months from the date of purchase, after which time they can be revalidated at a cost of 10% of the voucher value per month required subject to a minimum cost of £25.00. The gift vouchers must be extended before the expiry date has passed. Please allow 4 - 5 working days for your gift voucher to be delivered. Express 24 hour delivery of gift vouchers is available at an extra cost of £10.00 provided the booking is made before 3.00pm.
- Imdenmity Waiver and Insurance: - 6th Gear Experienced Ltd require all customers to complete an indemnity waiver form on the day of events prior to commencing their activity. This is completed by signing the relevant imdemnity form. 6th Gear Experience Ltd offer a damage waiver insurance which is available by paying a fee of £25. 6th Gear Experience Ltd agree that should there be any damage whatsoever to any of the vehicles I drive today, by purchasing the damage waiver insurance, I will not have to pay the first £2000 of damage as previously stated on the signing in sheet for my experience. The damage waiver Insurance is void if found to be driving negligently/dangerously or not listening to the instructors instructions. I confirm that I am not suffering from any illness or disability whether permanent or temporary or otherwise which is likely to affect my control of the vehicles being driven. I confirm I hold a valid UK/International driving license.
- Refunds and Cancellations
Experiences: - 6th Gear Experience Ltd are happy to make refunds on unbooked experiences, bought direct from 6th Gear Experience Ltd within 7 days of purchase, minus a 10% administration charge (being a minimum charge of £25 and a maximum charge of £50). After 7 days no refund will be available. An alternative named driver can be submitted, but a £25 administration charge will be applicable and the same time scale applies as re-booking time scales. 6th Gear Experience Ltd does not accept re-bookings if your event has been booked (unless covered under separate cancellation cover). Refunds are always made to the person who purchased the experience, and if originally purchased by credit card, the refund will be credited to the same card. If the card has expired you will need to request a refund in writing, quoting details of a new credit card. If you have a date specific or booked voucher then no refund or cancellation or other changes maybe made.
Gift Vouchers: - Protect your gift Voucher and treat it as cash, the balance can not be returned if it is lost or stolen. 6th Gear Experience Ltd is not responsible for any unauthorised use of your Gift Voucher. Your Gift Voucher can not be refunded once purchased. Your Gift voucher is not a credit, debit or cheque guarantee card. Your Gift Voucher can not be exchanged for cash.
- Cancellation Cover (Must be paid for separately): - This can be requested from our Customer Care Team on 01675 470425 or 05603 114969 before booking your activity at a cost of £20 and is valid for use one time only. If you have purchased this from 6th Gear Experience Ltd we will rebook an activity, within the vouchers validity period, if the customer should cancel an already booked activity session as a direct consequence of one or more of the circumstances set out below:
- Death within the immediate family.
- Breakdown on route to an event.
- Serious illness of participant.
- Any other reason considered valid by 6th Gear Experience Ltd
Relevant official recovery documentation must be provided for the above in the event of cancellation. Once purchased this policy is non refundable and does not fall within the 7 day conditions. This covers the participant taking part in the event and not the gift voucher this is only available on experiences up to the value of £299 please call if over this value for a bespoke cost.
- Session lengths and availability: - All experiences are offered subject to availability and weather conditions on the day. It may be necessary to book your day on certain experiences well in advance (please call our office for our advice and or availability 01675 470425 or 05603 114969 due to demand. Please book your experience well in advance allowing 8 to 12 weeks. We are unable to make provisional reservations. You are advised not to make travel, hotel or other arrangements until your booking has been confirmed in writing. Should any alterations have to then take place due to reasons beyond our control we shall not be held liable for any expenses incurred. Session lengths are approximate, vary from venue to venue and are given simply as an indication of the time you will spend at the venue. Unless stated otherwise, you will usually be taking turns with other people and there will be waiting time involved. We give timed itineraries as a guide only and the running order of an event may change without notice and 6th Gear Experience Ltd will not be liable.
- Adverse weather conditions & mechanical breakdown & cancellation of your booked event: - From time to time some of our experiences may have to be cancelled or suspended due to adverse weather conditions, reasons beyond our control or very occasionally mechanical breakdowns. Where this is a possibility, for example in the case of certain driving experiences every effort will then be made to contact you and or offer an alternative on the day or re-book the experience at the next available date and venue. 6th Gear Experience Ltd will not be responsible for any accommodation, travel or incidental expenses incurred by customers and every effort will be made on the day for your event to continue, even if the time scale is over and above expected booked time or we will offer you an alternative. Once you have booked your experience you are bound by the relevant suppliers terms and conditions and these will be implemented and adhered to at all times.
- Restrictions: - Certain experiences are subject to minimum or maximum requirements, e.g. age, health or weight. We will confirm with you at the time of booking if any restrictions apply to the participant. Once booked, you may be liable for charges if you have to cancel because the minimum requirements are not met. Full details are included in your gift pack and we ask you to read this carefully as soon as you receive it. (No Pets allowed) Children under 12 must always be accompanied by an adult we hold a no smoking rule whilst in vehicles or in any building on a 6th Gear Experience Ltd event. Alcohol is strictly forbidden from all our events. Anyone who is considered to be under the influence of alcohol or drugs will be excluded from all activities and entitled to no refund or rebook. All clients participating in motoring activities must hold a valid UK/International driving License unless specifically stated otherwise in the brochure, for example in the case of the junior driving. If you have any medical condition or disability which may affect your ability to undertake the experience this must be disclosed on the booking form where indicated. If you are in any doubt then please consult your doctor. To ensure the validity of any insurance cover we may in some instances ask clients over a certain age to produce a medical certificate. If you wish to arrange additional cover through our insurers we will be happy to put you in direct contact with them. Due to health and safety restrictions 6th Gear Experience Ltd operates an strict no spin rule at all our experience day events. The format of this is, that if the customer spins the supercar being driven on or off the track due to excessive speed or not adhereing to the instructors instructions their session is terminated with no refund. Our experience days are track based events and are not drift experiences and we expect our customers to drive as such and listen to the instructors comments.
- Spectators: - Are welcome to attend the event with no restrictions at all our venues, subject to the following conditions: Due to insurance restrictions, children under the age of 12 are permitted but must be supervised at all times whilst on the site by an accompanying adult. Dogs (except guide dogs) or pets cannot be admitted under any circumstances.
Please note it may be possible for spectators to participate in any of the activities subject to any unfilled places on the course for payment of the appropriate fee. There should also be events inc pay as you go Super Cars, & photos (subject to availability), again restrictions at all our venues do apply including speed restrictions for all drivers on the day and noise pollution where applicable.
- Clothing: - We recommend that you come prepared for the extremes of the British climate! Please wear comfortable driving clothing. On cold/wet days you will need warm waterproof clothing, gloves and hats, whilst on summer days the site can become extremely hot and dusty (sun cream). On dry days, wearers of contact lenses may experience some discomfort. It is recommended that soft soled shoes are worn as most supercars have minimal spacing between the operating pedals. Climbing boots are not recommended!
- Catering arrangements: - Catering facilities are available on site this does vary depending on venues.
- Driving ability: - We do ask that all participants bring their driving licenses with them for their event. We also request that you can drive a vehicle with a manual gear box.
- Changes to your booking: - Outside of 30 days of your event, one free ammendment to your booking can be made. Within 30 days of your event date an admin fee of £25 is payable to any changes made. Within three working days of your event no changes or cancellations can be made, unless cancellation insurance has been purchased prior to the 30 day cut off period. See point 5 above for further clarification.
- Definitions and Other General Information (please read carefully)
The pictures used in all promotional collateral to illustrate experiences, particularly those that take place at more than one location, are used as an indication only. The machines, vehicles, craft, animals and settings at each venue may vary and are subject to availability and or change.
In many instances experience duration will be influenced by weather and the number of persons participating on the day, as a result some waiting time may result. The pictures used and descriptions of experiences duration and availability on the website are intended to be a guide only for clients and do not form part of any contract with them. Since the equipment used, the settings in which they take place, as well as the supplier/venue may vary from time to time and are subject to change without notice to us the supplier. 6th Gear Experience Ltd reserves the right to make amendments and changes to their experiences without notice and will not be liable for doing so. However all reasonable steps are taken to ensure that the experiences provided fall within the general terms described in the brochure/description information file or website. Where this cannot be fulfilled alternative venues or experiences will be offered to the value of your gift voucher. All vehicles used on the day with 6th Gear Experience Ltd are subject to availability and or changes without notice and in the event of a vehicle not being available another vehicle maybe implemented but will be of equivalent performance.
Experience Description: - The information provided by 6th Gear Experience Ltd on each experience is correct at the time of print & website. However, the content or format of experiences may change during the year. Details of each experience are available from our website or our Customer Services Team on 01675 470425 or 05603 114969 Monday-Friday from 9am-5pm. All of 6th Gear Experience Ltd driving events are operated from March-November, you must book your experience in these months but the office is open all year round and you can book in anytime year round. You must take part in your experience within these months and it must be booked and taken before the expiry date of the voucher. We plan arrangements for your Experience many months in advance. Very occasionally changes may be made and we reserve the right to do so. This may involve having to reschedule the timing and/or location of an Experience, possibly at short notice, owing to availability, booking numbers, safety, technical problems or other factors beyond our control. We cannot be held liable for any costs incurred in any of these circumstances. We will try to provide an experience, location or other alternative wherever possible. In the unlikely event that an alternative cannot or is not offered, a full refund will be available at the discretion of 6th Gear Experience Ltd. Similarly, we reserve the right to withdraw supply of a gift without notice due to unavailability or discontinuance of a product line.
Website and Brochure Prices: - These are correct at the time of going to press but the company reserves the right to increase/decrease prices at its discretion. However where such price increases are, made clients will be notified before placing an order. If upon activating your gift voucher the customer will be asked to pay the difference. Gifts will only be issued after payment has been made in full to the company.
Details of Insurance: - With few exceptions, all our experiences involve some element of risk and danger. This is what creates the excitement and the thrill. Every customer is covered by our standard public liability insurance. You may wish to take out additional cover over and above that provided. Accordingly you are advised to consider insurance cover for personal accident, loss of limb and even death or indemnity insurance for damage caused to any vehicles on your event before embarking on your experience. 6th Gear Experience Ltd is not responsible for any risks not specifically covered by its own insurance and on arrival at your venue for a 6th Gear Experience Ltd experience you will be asked to sign a driver's indemnity as covered in point 3 above.
Withdrawal of your experience: - Its description and or locations Gift vouchers can range in price from £30.00 to £1,000.00+ and are valid for all the experiences shown in our Literature and web-site or brochure. If an experience has been withdrawn you and your recipient will be advised and offered an alternative as near as possible to the original. If this should prove to be impossible you will be offered an alternative with assistance from the customer service team, subject to payment or refund of any difference in price. If alternatives have been offered and dates are available no refunds will be available.
Delivery details of vouchers/ information from 6th Gear Experience Ltd:
Delivery to the UK mainland only is by first class post except for Brochure requests, which are sent second class
Special Delivery orders placed before 3.pm will be posted on the day ordered
Allow 7 days for delivery during peak postal times
Please note: delivery is by Royal Mail therefore 6th Gear Experience Ltd cannot be held responsible for delays caused by the postal system
No dispatch or delivery is available on UK bank holidays and weekends
Data Protection Act 1998
6th Gear Experience Ltd complies with each of the eight principles of the Data Protection Act 1998. Those principles require that data is:
- Fairly and lawfully processed
- Processed for limited purposes
- Adequate, relevant and not excessive
- Accurate
- Retained only for the necessary period
- Processed in accordance with the data subject's rights
- Held in a secure environment
- Not transferred outside the EU without adequate protection
All details supplied by clients or recipients of gifts remain confidential to the company. Under no circumstances will any information be supplied to third parties without our clients and or the recipient's specific authorities in writing, except where there is an emergency involving the statutory authorities.
All the above terms and conditions apply as a condition of using any voucher, whether or not the voucher holder is the original purchaser.
6th Gear Experience Ltd's liability for any claim of breach of obligation regarding any single voucher or experience shall not exceed the price of that experience. This excludes claims arising from personal injury or death due to the negligence of 6th Gear experience Ltd or anyone for whom we are responsible.
The text, illustrations and pictures used in all 6th Gear Experience Ltd marketing material are protected by copyright and must not be copied in whole or in part without the express permission of 6th Gear Experience Ltd.
The above terms and conditions are to be interpreted in accordance with the laws of England and Wales and the statutory rights afforded there under and subject thereto shall form the basis of the contract between the company and its corporate or individual client.
